These Terms and Conditions govern use of the Acton Fitness website and set out general rules for members, temporary members, and guests. Your signed membership agreement contains the specific price, term, billing schedule, and cancellation rights that apply to your membership. If these terms conflict with your signed agreement, the signed agreement controls to the extent permitted by applicable law.
1. Membership
- Memberships are personal, non-transferable, and non-refundable except as provided in the applicable membership agreement or required by law.
- Members must be at least 16 years old to use the facility without a parent or an owner-approved guardian. Additional requirements may apply to minors.
- By joining Acton Fitness, members agree to follow these terms, their membership agreement, posted facility rules, and reasonable staff instructions.
- Membership renewal is subject to the then-current agreement, rates, and policies disclosed to the member.
- Acton Fitness may refuse, suspend, or terminate access for lawful reasons, including safety concerns, nonpayment, misuse of the facility, or a material violation of club rules.
2. Facility Access and Conduct
Members must scan their authorized digital key or proximity card on each visit. Access credentials may not be shared. Entry is limited to members and authorized guests with valid access and an account in good standing.
Members and guests must use equipment responsibly, respect staff and other members, and avoid conduct that is unsafe, disruptive, abusive, discriminatory, illegal, or damaging to the facility. Acton Fitness may require a person who violates these standards to leave and may restrict future access as permitted by law and the applicable agreement.
Accidents, injuries, facility problems, or concerns should be reported promptly to a staff member at the front desk or by email to acton.gym@gmail.com.
3. Billing and Payments
Members selecting a pay-monthly membership may be required to pay the applicable registration fee and first month's membership fee in advance. Monthly membership charges are recurring and are generally charged to the payment card on file on the 25th of each month, one week before the month being paid for. The amount, billing date, initial term, and renewal terms shown in the signed membership agreement control.
Members are responsible for maintaining a valid payment method and sufficient funds. A failed payment may be submitted again. Acton Fitness may suspend facility access while an amount remains unpaid and may terminate the membership as allowed by the membership agreement. If a terminated member later rejoins, a new registration fee may apply.
4. Membership Cancellation
Acton Fitness offers annual, 12-month, shorter-term, and month-to-month memberships. Cancellation timing and any remaining payment obligations depend on the membership selected and the signed membership agreement. Unless the agreement or applicable law provides otherwise, submit a cancellation request at least 30 days before the next billing date.
These submission options are intended to provide a clear written record. Nothing in these terms limits any additional cancellation or refund right available under the signed membership agreement or applicable law.
5. Termination and Refunds
Acton Fitness may terminate a membership for nonpayment, unauthorized access, illegal activity, a serious or repeated rules violation, or conduct that threatens people or property. Amounts validly due before termination remain payable.
Refund requests are considered under the signed membership agreement, the circumstances of the request, and applicable law. A phone call may be used for a refund question but does not submit or complete a membership cancellation.
6. Hours and Facility Availability
Acton Fitness may adjust opening hours or temporarily close all or part of the facility when reasonably necessary for maintenance, repairs, safety, emergencies, holidays, or operational needs. When practical, advance notice of a material planned closure or rule change will be provided.
7. Health, Safety, and Hygiene
Exercise involves inherent risks. Members and guests are responsible for choosing activities appropriate to their abilities and should seek advice from a qualified healthcare professional before beginning or changing an exercise program when appropriate. Fitness information or instruction provided by Acton Fitness is not medical advice.
- Ask staff for an equipment orientation if you are unfamiliar with a machine or exercise.
- Wear clean, appropriate clothing and footwear and follow posted hygiene and equipment-cleaning rules.
- Tell an instructor about relevant injuries or concerns before a class begins.
- Stop exercising immediately and notify staff if you feel faint, dizzy, unwell, or experience unusual pain. Call 911 in an emergency.
8. Lockers and Personal Property
Lockers, when available, are for temporary use during a visit and may not be used overnight. Do not leave valuables unattended. To the fullest extent permitted by law, Acton Fitness is not responsible for loss, theft, or damage to personal belongings brought to the facility.
9. Website Use and Intellectual Property
You may use this website for lawful, personal, non-commercial purposes. You may not interfere with the website's operation or security, attempt unauthorized access, introduce malicious code, harass another person, or use the website in a way that violates another person's rights or applicable law.
Unless otherwise stated, website text, graphics, logos, photographs, and other content are owned by or licensed to Acton Fitness and may not be reproduced, republished, or commercially used without permission, except as allowed by law.
10. Third-Party Services and Links
The website links to services operated by third parties, including the membership portal, contact-form provider, class calendar, maps, and social platforms. Acton Fitness does not control those services and is not responsible for their availability, content, security, or privacy practices. Review the terms and policies of a third-party service before using it.
11. Disclaimers and Limitation of Liability
The website is provided on an “as available” basis. While we work to keep its information accurate and current, we do not guarantee that the website will always be uninterrupted, error-free, or complete. Current facility notices and the signed membership agreement control over general website information.
To the fullest extent permitted by law, Acton Fitness is not liable for indirect, incidental, special, or consequential damages arising from use of the website. Nothing in these terms excludes or limits a right or liability that cannot lawfully be excluded or limited. Any separate release or assumption-of-risk agreement signed by a member or guest also applies according to its terms and applicable law.
12. Changes, Governing Law, and Severability
We may update these website and general facility terms from time to time. Updated terms will be posted here with a revised date. Changes to a signed membership agreement will be handled according to that agreement and applicable law.
These terms are governed by the laws of the State of California, without regard to conflict-of-law principles. If a provision is found unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue in effect.
